A Lagos auto dealer, Kehinde Olamiji Olayinka Davies, has been been arraigned before an Ogba Chief Magistrate’s Court, Lagos, for alleged battering of a female co-tenant and conduct likely to cause breach of public peace.

The motor dealer was arraigned before the court presided over by Magistrate (Mrs.) O. I. Raji, by the Police from Oko-Oba division, Agege, Lagos.

The 48 years old man, was arraigned on Thursday, in a charge numbered MIK/816/2023, for allegedly beating his co-tenant, one Mrs. Nafisat Sanusi, and conduct likely to cause breach of public peace.

Arraigning the defendant, the prosecutor, Inspector Ajayi Emmanuel, told the court that the defendant, who resides at no. 17, William Elliot Estate, Abule Egba, Lagos, on April 16, 2023, at about 10. 30 p.m., assaulted victim, by beating her and causing her bodily harm.

The prosecutor also told the court that the defendant on the same date and place, conducted himself in a manner likely to cause breach of peace.

He told the court that the landlord’s alleged criminal acts, contravened sections 172 and 168 (D) of the Criminal Laws of Lagos State of Nigeria 2015, and punishable under the same laws.

The defendant denied the allegations and pleaded not guilty to the charges.

Upon his not guilty plea, the prosecutor, Inspector Ajayi, asked the court for trial date and equally asked that the defendant be remanded till the determination of the charges against him.

But the defendant through his lawyer, pleaded with the court to admit him to bail in the most liberal terms, on the ground that he is a first time offender and that the charges against him are bailable ones.

Magistrate Raji, who stood in for Magistrate (Mrs.) O. O. Fagbohun, admitted bail to the defendant in the sum of N100, 000,00, with two sureties in like sum.

The Magistrate also ordered that the sureties must present to court evidence of three years tax payment to Lagos State government. Adding that the bail terms must be verified by the prosecutor.

The Magistrate while ordered that the defendant be remanded till the perfection of the bail conditions, adjourned the matter till May 25, for mention.

Charges against the defendant read: “That you Kehinde Olamiji Olayinka Davies ‘M’, on the 16th day of April, 2023 at about 20. 30hrs at No. 17, William Elliot Estate, Abule Egba, Lagos in the Ikeja Magisterial District did assault one Mrs, Nafisat Sanusi ‘F’ by beating her up your hand and thereby committed an offence contrary to and punishable under section 172 of the Criminal Laws of Lagos State of Nigeria 2015.

“That you Kehinde Olamiji Olayinka Davies ‘M’, on the same date, time and place In the aforesaid Magisterial District did conduct yourself in a manner likely to cause breach of peace and thereby committed an offence contrary to and punishable under section 168 (D) of the Criminal Laws of Lagos State of Nigeria.”
