In a historic victory for grassroots democracy, the Supreme Court has granted financial autonomy to Nigeria’s 774 local governments, ending a two-decade-long era of financial shackles imposed by state governors.
The apex court’s landmark ruling declares it illegal for governors to withhold local government funds, citing a clear violation of the 1999 Constitution.
According to the statement,“Demands of justice require a progressive interpretation of the law. It is the position of this court that the federation can pay LGA allocations to the LGAs directly or pay them through the states.
“In this case, since paying them through states has not worked, justice of this case demands that LGA allocations from the federation account should henceforth be paid directly to the LGAs,” the apex court held.
This judgment empowers local governments to receive their allocations directly from the federation account, ensuring democratic governance and financial independence at the third tier of government.
The court’s decision is a significant win for the Federal Government’s efforts to secure financial autonomy for local governments, paving the way for more effective and accountable governance at the grassroots level.
