Justice Abimbola Awogboro of a Lagos Federal High Court, today, remanded two men, Micheal Ashimashiga and Godwin Abaniwo, in the custody of the Nigerian Correctional Services (NCoS), for their roles in alleged N11 million fraud.
Justice Awogboro made the remand order against the two defendants, after they pleaded guilty to the alleged charges of conspiracy, obtaining the sum of N11 million, by false pretence and issuance of dud cheques, made against them by the men of Police Special Fraud Unit (PSFU), Ikoyi, Lagos.
Meanwhile, the court has fixed November 7, for the hearing of their bail applications.
PSFU through it’s lawyer, Mr. Henry Obiaze, had arraigned the two defendants alongside their company, Eden Group Farmers Multi-purpose Coop Society Limites, before the court today, on the alleged offences
Obiaze, while arraigning the defendants, informed the court how they conspired among themselves and fraudulenty obtained the sum of N11 million, from one Tairu Oladimeji, under the guise of investing the money in the Moringa farming.
Obiaze told the court that the defendants, had pretentiously told their victim, that he will be receiving monthly Returns On Investment (ROI), on the sum they dubiously received from him.
He also told the court that when the defendants failed and refused to reimburse the money, they issued several First Bank’s cheques, which were rejected upon presented from cash at bank, due to insufficient funds in their account.
The prosecutor told the court that the offences committed by the defendants contravened Section 1(3) of the Advance Fee Fraud and Other Fraud Related Offences Act, 2006; Section 1(1) of the Dishonoured Cheques (Offence) Act, Cap. D11 LFN, 2004; and Section 15(a) (ii) of the Money Laundering (Prevention and Prohibition) Act, 2011. And punishable under the same Act.
All the defendants, pleaded not guilty to the charges.
Justice Awogboro, following the remand order sought for by the prosecutor, ordered that all the defendants be remanded in the NCoS’custody till November 7, for their bail applications to be heard and determined.
