The Court of Appeal, sitting Kano, Kano State, has annualled the controversial senatorial nomination of Danburam Nuhu of the Peoples Democratic Party, PDP, and uphold the senatorial candidacy Laila Buhari of the PDP’s Kano Central Senatorial District.

The Appeal Court in Kano also approved the party’s primaries conducted by the PDP faction executives under the leadership of Alhaji Shehu Sagagi whose credible primary was clearly won by Laila Buhari as her candidate.

It would be recalled , on September 26, Kano Federal High Court kicked out the case for lacking in the jurisdiction of the Court, which according to the Court should have been filed in Abuja as the case was filed in Abuja instead of Kano in line with the directives of the National Judicial Commission, NJC, on post-election cases.

in a landmark judgement of the appellate court delivered in Kano on Wednesday, November 23rd by Justice Ita Mbaba, the court dumped running of the lower court of trial. Justice Mbaba stated that the lower court erred in her judgement based on the jurisdiction of
the Court.

While hearing the newly re-filed case on its merit the court stated that in a pre-election case, the Federal High Court Rules and the Constitution of the Federal Republic of Nigeria (1999) as amended shall supercede over the National Judicial Commission, NJC, policy, which the Federal High Court drew her judgement from.

The Appeal court instantly ordered INEC to cancel Mr Damburam’s name as PDP Candidate and put down Mrs Buhari’s name as substantive Candidate for Kano Central Senatorial District.
