The Igbosere Magistrate Court sitting in Ebute Metta, Lagos has dismissed the case of conspiracy, forgery and stealing against five employees of UACN Property Development Company Plc (UPDC).
UPDC had in May 2016 before The Magristrate Court of Lagos in Igbosere, Lagos levelled allegations of conspiracy , forgery and stealing against Cyril Oaku, Ogundipe Victoria, Toyin Marcus, Adekoya Olushola and Da-silva Bankole who at that time, were employees of the company. The defendants pleaded not guilty to the charge when read to them and were granted bail by the Court while the case continues.
It was however gathered that the Prosecution team has not been forthcoming in their diligence in prosecuting the case since 2016 and Tunde Abioje counsel to the 1st , 4th and 5th Defendants prayed the Court to dismiss the case for want of diligent prosecution under Sections 232 and 248(1) of Administration of Criminal Justice ( Repeal and Re- Enactment) Law of Lagos State 2015 with the combined effects thereof as dismissal, acquital and on merit.
In her judgment, the presiding Chief Magistrate said based on the combined effect of Sections 232 and 248 (1) of ACJL 2015, the case is dismissed against all the Defendants and this, according to her, is tantamount to acquittal on merit.
