Alleged N64m Fraud: Court Grants IGP Request To Arrest Fugitive Fraudster | The Legend News

A Lagos Federal High Court, today, granted the request of the Inspector-General of Police (IGP) to arrest an alleged fugitive, Olusanya Sunday Okusanya, said to have absconded to United Kingdom (UK).

Justice Yellim Bogoro, granted IGP’s request to arrest the suspect, after taken a motion Exparte for his arrest, filed and moved by Barrister S. O. Ayodele, a lawyer in the legal department of Force Criminal Investigation Department ForceCID Annex Alagbon-Ikoyi Lagos.

The suspect, Olusanya Sunday Okusanya, was said to have absconded to UK after he allegedly obtained the sum of N64 million from one Helen Nkeihuka Isichei, by false pretence.

At the hearing of the Exparte motion for the suspect, the IGP’s lawyer, Ayodele, told the court the motion is pursuant to sections 113 and 114 of the Administration of Criminal Justice Act (ACJA) 2015;  Extradiction (Modification) Order 2014; Federal High Court Extradiction Procedure Rules 2015 and Under the court’s inherent Jurisdiction.

Ayodele also informed the court that the Exparte motion is attached with a charge sheet of a two count-charge against the suspect, an affidavit of seven paragraphs, written address and several exhibits.

Justice Bogoro after listening to the submissions of the lawyer to the IGP, held that the application has merit and granted same accordingly.

The judge thereafter adjourned the matter to  December 10, for report and possible arraignment of the suspect.

Parts of the affidavit in support of the motion Exparte deposed to by one Suleiman Ilu, a Superintendent of Police (SUPOL) reads: “….. that the office of the Deputy-Inspector General of Police, Nigeria Police Force, Force Criminal investigation Department (FCID), Area 10, Abuja received a petition titled the need to involve INTERPOL Department.

“That one Helen Nkeihuka Isichie whom is the nominal complainant made a statement to the Police confirming the contents of the petition. And that the INTERPOL section of the Force has carried out an investigation into this matter and found the defendant/respondent culpable. 

“That the defendant/respondent is believed to have absconded to the United Kingdom after he committed the alleged offence. And that the INTERPOL Section of the ForceCID Annex, Alagbon is working in conjunction with the Ministry of Justice to facilitate mutual legal assistance to repatriate the defendant/respondent to enable him stand trial. 

“That it will be in the interest of Justice to grant this application to enable the Applicant arrest the defendant/respondent and ensure his attendance in Court.”

While the pending charges against suspect read: “that you, Olusanya Sunday Okusanya “M” sometimes in 2022, in Lagos, with in the Judicial Division of this Honourable Court, did by False Pretense and with intent to defraud obtained the sum of Sixty Four Million Naira (N64, 000,000:00) from one Helen Nkeihuka Isichei and thereby committed an offence contrary to Section 1 (1) (c) and punishable under Section 1(3) of Advance Fee Frand and other Related Offences Act 2006, Laws of the Federation of Nigeria.

That you, Olusanya Sunday Okusanya “M” on the same date, time and place, and in the aforementioned Judicial Division of the Federal High Court , did steal the sum of Sixty Four Million Naira (N64,000,000:00) from one Helen Nkeihuka Isichei and thereby committed an offence contrary to Section 383 and punishable under Section 390 (9) of the Criminal Code Act , Cap. C38, Laws of the Federation of Nigeria, 2004.”
